Catastrophic complex litigation involves cases where the damages to the victim and the victim's family are extremely large, are often permanent, and will require a lifetime of financial, medical or other support. In our many years of proven success, we have handled catastrophic damage cases that have included a hospital helicopter crash, a near-electrocution involving an aerial lift, a magnesium foundry explosion, ingestion of a low-molecular-weight hydrocarbon, brain damage due to hospital and medical negligence, overhead crane malfunction resulting in paralysis, and death due to excessive force by police.
These cases are called catastrophic since the injuries and damages to the victim and their family are so severe. In order to document and help alleviate the damage, we often obtain psychological assessment and treatment, vocational assessment and treatment and/or an evaluation by a nationally known economist who present-values the damages. On occasion, we will also seek the opinions of neuroradiologists, neuropsychologists, neurosurgeons and orthopedic specialists, and other expert witnesses.
The litigation is often complex since there are often multiple party defendants who are involved in these actions under multiple different theories of liability. Some of the cases we have worked on have had in excess of 10 party defendants, have required in excess of 50 depositions, have required more than 5 experts for our victim and have required tens of thousands of dollars in expert fees and file expenses to litigate. These cases usually require two to four weeks of trial and often involve two or more attorneys from our office as well as three to four support staff to gather evidence, schedule and organize the file. We also sometimes retain a video service to create a "day in the life" of the victim.
